Commissioners Extend Burn Ban,
Hire Counsel for EEOC Complaint

By JERRY MORGAN, Reporter

COMANCHE -- Despite the county having received general rains only one day earlier, Comanche County Commissioners agreed on Monday that the total outdoor burn ban should be extended.

Jimmy Dale Johnson conducted the Commissioners Court meeting on Monday, April 13, acting in the absence of County Judge James Arthur.

The meeting was held in the County Courtroom on the first floor of the courthouse, its usual location. Other Commissioners present included Corky Underwood, Kenneth Feist and Sherman Sides.

While distributing drought and fire danger maps, county Emergency Services Coordinator Ray Helberg noted that the preceding week had been one of the worst weeks for wildfires in recent times.

He stated, "I would suggest that we stay in the burn ban."

Council Members Discuss Restrictive Provisions

on Cross Timbers Health Clinic Warranty Deed

By LAURA KESTNER, Editor

A request by a representative of the DeLeon Cross Timbers Health Clinic for the DeLeon City Council to “remove restrictive provisions from special warranty deed” was the first item of business during the most recent council meeting, Thursday, April 9, 2009.

CROSS TIMBERS HEALTH CLINIC. The Cross Timbers Health Clinic is located near the DeLeon Senior Citizens Center and the baseball fields.

All council members -- Mayor Danny Owen, Lee Childers, Pauline Villarreal, Billie Lightfoot and Gayle Stroud -- were present for the 6 p.m. meeting. Also present were Karen Wilkerson, city administrator/secretary; Ralph Dickey, police chief; Rob Duncan, public works administrator and Tim Fanning, DeLeon police officer.

Sueann Porter, the chief financial officer and interim chief executive officer, of Cross Timbers Health Clinic, told council members that financial concerns were the driving force behind asking for the removal of the restrictive provisions.

The restrictive provisions in the special warranty deed (which was dated May 19, 1992) say that the Grantee shall (i) occupy...for the provision of public health services within Comanche County and (ii) thereafter use and occupy the property continuously at all times as its primary place of business, clinic, and headquarters for the provision of public health services in Comanche County” and “...provided that if the property ceases to be used as Grantee’s primary place of business, headquarters, and as a public health services clinic for the citizens of Comanche County, Texas, it shall automatically revert to and be owned by Grantor without the necessity of any further act on the part of the Grantor.”

“The reason we’re asking you to remove the restrictive provision on the warranty deed,” Porter said, “is because we’re needing to borrow money against the building to replenish operating reserves that were utilized for an expansion and remodel on the current building. We had expected some philanthropic contributions to come in when we began this project at the end of 2007, but with the current economic that was not forthcoming.”
